Expert Determination
Expert determination is where the parties to a dispute agree to refer it to an expert third party and be bound by his decision. It is different from arbitration in that the parties can put their own point of view forward, but they can also authorize the third party to carry out appropriate investigation of other possible evidence.
This means that the expert’s determination is not just based on what the parties say, but may take account of anything else which is relevant and within the bounds of what has been agreed.
